Will of Thomas Gawn, Balclutha

This is the last Will and testament of me Thomas Gawn of Balclutha in Otago, New Zealand, Saddler.  I revoke all wills and testamentary dispositions heretofore made by me. If my wife Isabella Gawn shall survive me I give devise and bequeath to her all my real and personal estate of whatsoever kind and wheresoever situate and appoint her to be my executrix of this my will. But if my said wife shall die before me then and in such case I give and devise allotments nine and nineteen Block Four Battrick’s sub-division in the Town of Balclutha and my freehold section in Rosebaulk to my daughter Sarah Jane Gawn.  I give and devise allotments sixteen and eighteen Block Four aforesaid to my daughter Elizabeth Clarke Gawn. I give and bequeath my household furniture and effects and a legacy of One thousand pounds to my said daughter Sarah Jane Gawn.  I gie and bequeath a legacy of Five hundred pounds to my said daughter Elizabeth Clarke Gawn.  I give and bequeath my fifty shares in the South Otago Freezing Company Limited and a legacy of Five hundred pounds to my daughter Edith Isabel McLean.  I give devise and bequeath all the residue of my real and personal estate not hereinbefore otherwise disposed of until my said daughters Sarah Jane Gawn and Elizabeth Clarke Gawn their executors administrators and assigns respectively upon trust that the said Sarah Jane Gawn and Elizabeth Clarke Gawn or the survivor of them or the executors or administrators of such survivor or other trustee or trustees for the time being of this will shall at such time or times and in such manner as they or she shall think fit sell call in convert into money the said real and personal estate or such part thereof as shall not consist of money and shall with and out of the money produced by such sale calling in and conversion and with and out of such part of any personal estate as shall consist of money pay my funeral and testamentary expenses and debts the legacies bequeathed by this my this my will and codicil hereto all estate and succession duty payable in respect to  my estate or any part thereof and all costs and expenses incurred in connection with the administration of my estate and shall stand possessed of the residuary trust monies in trust as to one half thereof for my said daughter Sarah Jane Gawn as to one quarter thereof for my said daughter Elizabeth Clarke Gawn and as to the remaining quarter thereof for my said daughter Edith Isabel McLean provided always that if any of my said daughter shall die in my lifetime leaving a child or children who shall survive me and attain the age of twentyone years or marry then in every such case the last mentioned child or children shall take and if more than one equally between them the share which which his her or their parent would have takenof and in the said residuary trust moneys if such parent had survived mr.  I declare that my trustees or trustee may apply the whole or any part of the income of the share in the said residuary trust moneys to which any minor would for the time being be entitled in possession under the trusts of this my will if he or she were of the age of twentyone years or married for ontowards the maintaince and education of such infant with liberty to pay the same to the guardian or person for the time being having the custody of such infant for the purpose aforesaid without being liable to see to the application thereof and shall invest the residue, if any, of the said income and the resulting income thereof so as to accumulate at compound interest to the intent that such accumulations shall be added to the principal share from which the same shall have arisen and follow the destination therof but my trustees or trustee may at any time resort to the accumulations of any preceding year or years and apply the same for or towards maintaince or education of any person for the time being presumptively entitled thereto and I also declare that any trustees or trustee amy at their or her discretion raise any part or parts not exceeding and together one moiety of the contingent share of any minor in the said residuary trust moneys and may either pay the moneys to be so raised as aforesaid to such minor or otherwise apply the same for his or her advancement preferement or benefit as my trustees or trustee shall think fit and I appoint my said daughters Sarah Jane Gawn and Elizabeth Clarke Gawn to be the executors of this my will.  In Witness whereof I have herewith subscribed my name this twenty seventh day of April One thousand nine hundred and twentytwo.
